FFAnet considers the above practices to constitute abuse of our service and of the recipients of such unsolicited mailings and/or postings, who often bear the expense. You and FFAnet are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement. Any controversy or claim arising out of or relating to this Agreement or our services shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Austin, Texas, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. Either you or FFAnet may seek any interim or preliminary relief from a court of competent jurisdiction in Austin, Texas necessary to protect the rights or property of you or FFAnet pending the completion of arbitration. We reserve the right to refuse service to anyone. We may also make changes to these rules and regulations with a 30 day notice. In addition, FFAnet reserves the right, where feasible, to implement technical mechanisms which block multiple postings as described above before they are forwarded. Nothing contained in this policy shall be construed to limit FFAnet's actions or remedies in any way with respect to any of the foregoing activities, and FFAnet reserves the right to take any and all additional actions it may deem appropriate with respect to such activities, including without limitation taking action to recover the costs and expenses of identifying offenders and removing them from the FFAnet service. In addition, FFAnet reserves at all times all rights and remedies available to it with respect to such activities at law or in equity.
